These Terms of Sale and Use (the “Terms”) apply to munafaexpress.com (the “Site”) and to every order placed on it. The Site is operated by MUNAFAEXPRESS LLC, a New Hampshire limited liability company, 923 Elm St #9, Manchester, NH 03101, USA (“MunafaExpress”, “we”, “us”). 1. About these Terms
By using the Site or placing an order, you agree to these Terms, our Shipping & Returns policy, our Refund Policy and our Privacy Policy, which form part of these Terms. If you do not agree, please do not use the Site.
We may update these Terms from time to time. The version shown here, with its “Last updated” date, applies to orders placed from that date. Changes do not affect orders already placed.
2. Using the Site and your account
- You must be at least 18 years old, or use the Site with the involvement of a parent or guardian. The Site is not directed to children under 13, and we do not knowingly collect their personal information.
- You can check out as a guest. If you create an account, keep your password confidential and tell us promptly if you think someone else has used it. You are responsible for activity on your account.
- We may suspend or close accounts that are used for fraud, payment testing, abuse or other breaches of these Terms.
3. Orders, prices and taxes
- Your order is an offer. After you order we email an order confirmation; this confirms that we received your order. A contract is formed when we accept it, which happens when we dispatch the item and email you the tracking details.
- We may decline or cancel an order (for example if an item is unavailable, if we suspect fraud, or if there is an obvious error in price or description). If we cancel, we refund any amount paid in full.
- Prices are in US dollars and are shown at checkout before you pay. Standard shipping to US addresses is free. Sales tax is added at checkout where the law requires it.
- Pricing errors: if an item is listed at an obviously incorrect price, we will contact you before dispatch and you can choose to buy at the correct price or cancel for a full refund.
- Product images are for illustration; colors can look slightly different on different screens.
4. Payment
We accept major credit and debit cards (processed by Stripe) and PayPal. Payment is taken when you place your order. Card details go directly to our payment providers; we never see or store your full card number. Orders may be screened for fraud, and we may ask for additional verification before dispatch.
5. Shipping and delivery
- We ship to addresses in the United States. Processing and delivery estimates are shown on each product page and explained in our Shipping & Returns policy.
- If we cannot ship within the time we stated, we will email you a revised shipping date and you may cancel for a full refund. If you cancel, the refund is issued within 7 business days.
- Title to the items and the risk of loss pass to you when the items are delivered to the shipping address you gave us. If a package is lost in transit, we replace it or refund you as described in our Shipping & Returns policy.
- Please make sure your shipping address is correct. Contact us right away if it needs to change; we can update it before dispatch.
6. Cancellations, returns and our 30-day guarantee
- Cancellations: you can cancel free of charge at any time before your order ships.
- 30-day guarantee (limited warranty): if an item arrives damaged, defective, wrong or not as described, tell us within 30 days of delivery with your order number and a photo or short video. We will send a free replacement or give you a full refund, including any shipping you paid, and you will not need to return the item.
- Change of mind: because items ship directly from our partner warehouses, we do not accept returns for change of mind or wrong size ordered.
- Any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited to 30 days from delivery, to the extent permitted by law. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. This guarantee gives you specific legal rights, and you may also have other rights that vary from state to state.
- Nothing in these Terms limits any rights you have under the consumer protection laws of your state.
7. Product information and safe use
We work to describe products accurately, including materials, sizes and where each item ships from. Please read the description and any size chart before ordering, use products as described and follow any care or safety instructions. Electrical items are for use with US standard outlets unless stated otherwise. Some items (for example decorations with small parts) are not suitable for young children.
8. Reviews and content you send us
- We may invite you to review an order. Reviews must be your honest opinion of a product you received. We publish positive and negative reviews alike and do not edit their meaning, but we may remove reviews that are unlawful, abusive, contain personal data or are unrelated to the product.
- By submitting a review, photo or message, you allow us to display it on the Site and in our marketing with your first name, and you confirm you have the right to share it.
9. Acceptable use
You agree not to: use the Site for fraud or to test payment cards; create accounts or place orders with automated tools; scrape, copy or resell Site content without permission; attempt to access systems or data you are not authorized to access; interfere with the Site’s security or operation; or break any applicable law.
10. Intellectual property
The Site and its content, including text, graphics, photos and the MunafaExpress name and logo, belong to us or our licensors and are protected by intellectual property laws. We give you a limited, revocable, non-exclusive permission to use the Site for personal, non-commercial shopping. All other rights are reserved. Product brand names belong to their owners.
If you believe content on the Site infringes your copyright, email support@munafaexpress.com with the details and we will review it promptly.
11. Disclaimers
Apart from our 30-day guarantee and any rights that cannot be excluded by law, the Site and its content are provided “as is” and “as available”. We do not promise that the Site will always be available or error-free. Links to other websites are provided for convenience; we are not responsible for their content. Information on the Site is general and is not professional advice.
12. Limitation of liability
To the fullest extent permitted by law: (a) we are not liable for any indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the Site or any product; and (b) our total liability for any claim related to an order is limited to the amount you paid for that order. These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence, or for fraud. Some states do not allow these limits, so they may not apply to you.
You agree to compensate us for losses caused by your misuse of the Site or your breach of these Terms, to the extent permitted by law.
13. Disputes and governing law
- Talk to us first. Most issues are solved quickly by email. Before starting any claim, please contact support@munafaexpress.com and give us 30 days to resolve it.
- These Terms are governed by the laws of the State of New Hampshire, USA, without regard to its conflict-of-law rules. This does not take away the protection of mandatory consumer laws of the state where you live.
- Any dispute that is not resolved informally will be decided by the state or federal courts located in New Hampshire, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in a small-claims court that has jurisdiction.
14. Cookies
We use cookies and similar technologies to run the store (for example your cart and login), to keep the Site secure, to measure visits and to show relevant ads. Visitors in the European Economic Area, the United Kingdom and Switzerland are asked for consent before non-essential cookies are used. You can delete or block cookies in your browser settings, but parts of the Site, such as the cart, need them to work. Details are in our Privacy Policy.
15. Your privacy
Our Privacy Policy explains what personal information we collect, how we use and share it, and your choices and rights.
16. General terms and contact
- We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, carrier disruptions or natural disasters.
- If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right right away, we have not waived it. You may not transfer your rights under these Terms; we may transfer ours to a business that takes over the Site.
- These Terms, together with the policies linked above, are the entire agreement between you and us about the Site and your orders. We may send you notices by email to the address you gave us.
